My construction law practice includes most matters involved with the construction, renovation or repair of buildings or improvements to land in Oregon. Past and present clients typically include commercial property owners, general contractors, subcontractors, design professionals, suppliers of material and rental equipment and product manufacturers.

Some examples of matters within my practice include:

Drafting or Negotiating Effective Construction Documents.  I draft or negotiate agreements for contractors, subcontractors, design professionals and owners associated with anything from small commercial or residential projects to sophisticated, multi-stage private commercial and public projects. 

Compliance with Contractor Licensing and Public Contracting Requirements.   I assist construction professionals comply with the statutes and regulations of the Oregon Construction Contractor’s Board and other license or professional registration boards. 

Construction Claims and Litigation.   I represent construction professionals in litigation matters (court or private arbitration), both on offense (in payment claim matters) and defense (helping construction professionals respond to claims and when appropriate, involve insurance carriers). I also act as an arbitrator.

Construction Lien, Bond and Payment Claims.  I have extensive experience preparing and filing Oregon construction liens (known in other states as Mechanic’s Liens), Oregon Little Miller Act surety bond claims, Federal Miller Act surety bond claims, private surety bonds, and Oregon license endorsement bond claims. Over my career, I have prepared and recorded well over a hundred Oregon lien claims (ranging in amounts from several hundred to several million dollars) and helped owners and contractors successfully mitigate or defeat such claims. I regularly pursue collection claims in court and arbitration to recover debts associated with construction, whether they are open account claims or recovery of damages. 

Complaint Process and Other Matters Arising from Oregon State Regulatory Boards. I have regularly assisted construction professionals in matters concerning the Oregon Construction Contractor’s Board (“CCB”) and other regulatory boards, including license suspension or non-renewal. 

Impact of Bankruptcy.   I advise construction professionals on the impact of bankruptcy on construction process and the ability to collect construction debts within the bankruptcy process, particularly those debts that may be secured by a construction lien or asserted against a payment bond.
